1. Introduction
Welcome to Community Spotlight, a service operated by Southern Imprint Marketing. Community Spotlight provides an online platform that allows businesses to reserve advertising space, submit artwork, review digital proofs, make payments, and participate in direct-mail advertising campaigns distributed to residential communities. By using our website, creating an account, reserving advertising space, uploading content, or purchasing advertising services, you agree to these Terms of Service.
2. Eligibility
You must be at least 18 years old and have authority to act on behalf of yourself or your business. You agree to provide accurate, complete, and current information.
3. Customer Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
4. Advertising Campaigns
Advertising availability is limited and reservations are subject to approval. Community Spotlight reserves the right to determine advertiser categories, campaign eligibility, and category exclusivity at its sole discretion.
5. Artwork and Customer Content
You retain ownership of logos, photos, trademarks, and other materials you submit. By uploading content, you grant Community Spotlight permission to use, reproduce, modify for production, print, distribute, and display that content in connection with your purchased advertising campaign. You are responsible for ensuring you have the rights to all submitted content.
6. Proof Approval
Customers are responsible for carefully reviewing all proofs, including spelling, grammar, phone numbers, addresses, websites, pricing, logos, images, QR codes, and other ad content. Approval of a proof is final acceptance of the advertisement. Community Spotlight is not responsible for customer-approved errors.
7. Payments
Payments are processed through secure third-party payment providers. Community Spotlight does not store complete credit card information. Advertising space may be released if payment is not received by applicable campaign deadlines.
8. Refunds
Refund eligibility is governed by our Refund Policy. Once a campaign has been approved for production, including after final proof approval and submission to print, all sales are final and no refunds will be issued except where required by law or when an error is caused solely by Community Spotlight.
9. Prohibited Uses
You may not use Community Spotlight to violate laws, submit fraudulent information, impersonate others, infringe intellectual property rights, upload malicious software, or submit offensive, defamatory, obscene, misleading, or unlawful content. Community Spotlight may reject advertisements at its discretion.
10. Intellectual Property
The Community Spotlight website, software, branding, graphics, logos, design elements, and related content are owned by Southern Imprint Marketing unless otherwise indicated. You may not copy, reproduce, or distribute our platform materials without written permission.
11. Service Availability
We do not guarantee uninterrupted service. The website may be unavailable due to maintenance, updates, third-party outages, internet failures, weather events, or other circumstances beyond our reasonable control.
12. Limitation of Liability
To the fullest extent permitted by law, Community Spotlight and Southern Imprint Marketing are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business opportunities, postal delays, third-party printing delays, service interruptions, or customer-approved artwork errors. Our total liability shall not exceed the amount paid for the applicable advertising campaign.
13. Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, abuse our services, fail to satisfy payment obligations, or submit prohibited content.
14. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this website with a revised Last Updated date. Continued use of Community Spotlight after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate state or federal courts located within Mississippi.
